Training Benchmark Changes for Employer Sponsors from 1 July 2017

To be approved as a Standard Business Sponsor for the 457 Program employers must show they have met one of the two training benchmarks.
The training benchmarks are also relevant when applying for permanent residence under the Employer Nomination Scheme (ENS).

Important changes were introduced to the training benchmarks on 1 July 2017 – this article explains how the changes will impact employers.

Benchmark A – Payments to a Training Fund

This involves paying 2% of payroll to an industry training fund. From July 2017 payments may be made to one of the following:
Industry training fund
Fund managed by recognised Industry Body
Scholarship fund operated by Australian TAFE or University

The following types of expenditure are now not eligible:
Funds operated by RTOs or private individuals
Funds paying commissions or offering refunds if application fails
The main impact of this change is that the previous practice of private education providers accepting payments for Benchmark A will be discontinued. Many of these providers would pay commissions to migration agents referring clients.
Benchmark B – Expenditure on Training Australians in the Business

This involves spending 1% of payroll on training Australians in the business. From July 2017 payments may include:
Formal courses of study + associated costs (eg travel)
RTOs delivering face-to-face training which contributes to formal qualification
eLearning or training software
Apprentices, trainees or recent graduates
Training officers – must be sole role
Attending conferences for CPD

The following types of expenditure are now not eligible:
On-the-job training – previously, structured on-the-job training could be counted in some circumstances
Training not relevant to business’ industry – it is not clear how closely related the training must be to the industry
Training of principals or family members – previously, training of family members could be counted providing it was also made available to other employees
Induction training
Salaries of staff attending training
Membership fees – previously allowable
Books, journals or magazine subscriptions – previously allowable
Conferences for purposes other than CPD
Hiring a booth at trade show, conference or expo

It appears that payment of external providers to deliver training for Australian employees, is excluded unless it leads to a formal qualification. This would form the bulk of the training expenditure of most businesses and so many will need to restructure their training to comply with the new Benchmark B.
Calculation of Payroll

As a general rule, payroll includes:
wages and salaries as per state payroll legislation, and
payments made to contractors or subcontractors if the work completed is related to services or products provided by sponsor
If the employer does not have a payroll they would count Directors’ salaries, fees and drawings, or the profit of the business.
Timing of Training Activities

Payroll and training expenditure must be for the same period.
Previously, businesses operating for 12 months or more were required to demonstrate this expenditure in the 12 month period prior to lodgement. From July 2017, this expenditure may be for the 12 months prior to lodgement, or previous full financial year – this should help employers to gather relevant information and documentation.

Start-up businesses operating for less than 12 months will be required to show they have an auditable plan to meet these benchmarks.

Summary of 1 July Changes 2017

A number of changes to Working Holiday, General Skilled Migration and Employer Sponsored visas have been announced as part of the 1 July changes.

This article goes through these changes and gives brief explanations of the impacts.

General Skilled Migration

From 1 July, all applicants for General Skilled Migration must be under 45 at the date of invitation. Previously, legislation was released which amended the Skilled Independent Subclass 189 visa, but it is now clear that this will also be the case for Skilled Nominated Subclass 190 visas and Skilled Regional Provisional Subclass 489 visas.
New skilled occupations lists also apply for people invited on or after 1 July 2017 – one for Skilled Independent Subclass 189 or Family Sponsored 489 visas, and a separate one for State/Territory Nominated Subclass 190 or 489 visas.

Temporary Work (Skilled) Subclass 457 Visas

There were a number of 1 July changes to 457 visas including:
Training Benchmarks: more restrictions on which training is acceptable for 457 sponsorships and ENS nominations, as well as calculation of payroll expenditure for these benchmarks
New 457 Occupations List: a new occupations list applies to 457 visas with many occupations added back the approved list. A few have been removed entirely from the approved lists, with a number of occupations moving between the MLTSSL and the STSOL.
English Language Exemption: previously, applicants with base salary of $96,400 were exempt from English language testing. From 1 July, the high salary exemption will only apply where the applicant is already working for an associated entity of the sponsor overseas
Skills Assessment for trade occupations: formal skills assessment will be required for more trades and passport countries
Police Clearances: police clearances will be required for 457 applications lodged on or after 1 July 2017
Accredited Sponsorship Expanded: accreditation gives priority processing to 457 nominations and visas. Previously, it was only available for “high volume” sponsors who lodged at least 10 457 visas in the last 2 years. From 1 July, “low volume” sponsors will also be able to be accredited providing they have minimum turnover of AUD 4 million and have at least 90% Australian staff
Permanent Employer Sponsorship (ENS and RSMS)

For the Direct Entry Stream of ENS and RSMS, the following changes were made:
New occupations list for ENS Direct Entry – the RSMS list is essentially unchanged
Maximum age of 44 for applications lodged on or after 1 July 2017
Removal of English testing and skills exemption for people with a base salary of at least $180,000 – this change affects applications lodged on or after 1 July 2017, or prior to this if they are still undecided
For the Temporary Residence Transition Stream (TRTS), the changes were:
Higher English requirement: Competent English is required for applications lodged on or after 1 July – this is the same as for the Direct Entry stream
Genuine Position: Employers must now show that there is a genuine need for a paid employee in the position – similar to the Direct Entry stream
Fee Increases

Department of Immigration fees were increased by 2% for most application types. This affects the first Visa Application Charge for both the main applicant and any dependent family members. The Acacia Immigration Fee Calculator has been updated to reflect the new fees.
Working Holiday Visa Age Limit

The maximum possible age for the working holiday visa at grant was raised from 30 to 35 years. This will only be available for countries which have a bilateral agreement with Australia to this effect. There are no countries as yet specified with the higher age limit.

Skilled Occupations Lists for 2017-18 Released

The Skilled Occupations lists for the 2017-18 program year have been released. This article explains how the new lists work and which occupations have been added and removed.
General Skilled Migration

Prior to 1 July, a single MLTSSL applied to both Employer Sponsored and General Skilled Migration programs, and also a single STSOL.
However, the lists are different between the two programs from 1 July and are best thought of as:

IFSOL: Occupations for Skilled Independent Subclass 189 visas and Family Sponsored Skilled Regional Provisional Subclass 489 visas – we refer to this as the IFSOL (Independent and Family Sponsored Occupations List) in the table below.
STNOL: Occupations for state and territory nominated 190 and 489 visas – referred to as the STNOL below (State/Territory Nominated Occupations List).
IFSOL and STNOL are not terms used in the Legislative Instruments, but are useful in understanding which lists apply to particular visa pathways.
6 occupations have been removed from the list for Skilled Independent and family sponsored 489 visas as compared to the pre 1 July MLTSSL. Removed occupations include Sea Transport Professionals and Psychotherapists (removed entirely) and the occupations of Production Manager (Mining) and Anaesthetists which are still available for State/Territory Nomination.

13 occupations have been removed from the approved lists entirely – these include Senior Managers, Statisticians, Economists, Mining Engineers, Engineering Professionals NEC and Chemists.

16 occupations have been added to the State/Territory Nominated list which were not previously available – these include Air Transport Professionals, ICT Support Staff, Butchers and Retail Buyers.

Employer Sponsored Visas

The 457 visa and the ENS Direct Entry Stream share the same occupations list. The list is split into MLTSSL occupations and STSOL occupations. MLTSSL occupations result in a 457 visa valid for up to 4 years, whereas the maximum duration of a 457 visa in an STSOL occupation is only 2 years.
In the table below, these occupations are listed under the ESOL (Employer Sponsored Occupations List) column and we have indicated whether they are on the MLTSSL or STSOL.

Compared to the lists prior to 1 July, 18 occupations have been removed entirely – these include marine transport professionals, psychotherapists, medical administrators and property associate professionals.

27 occupations have been added to the approved lists including R&D Managers, life scientists, air transport professionals, ICT Support roles, butchers, Music professionals, metallurgists and horse trainers.

22 occupations have been moved from the STSOL to the MLTSSL including senior management positions, environmental scientists and university lecturers. 2 occupations have moved from the MLTSSL to the STSOL.

Caveats which previously applied only to 457 visa applications will now apply to ENS Direct entry applications as well – these may specify the type of business, nature of the role or minimum salary required for approval.
